Terms of service

Overview

This website is operated by SJR ECOMMERCE LTD trading as Pulse & Rest.

Throughout this website, the terms “Pulse & Rest”, “we”, “us” and “our” refer to SJR ECOMMERCE LTD trading as Pulse & Rest.

We provide this website, including the information, products, services and functionality available through it, subject to these Terms of Service and the policies referenced within them.

By accessing our website, creating an account, submitting an enquiry or purchasing products or services from us, you agree to be bound by these Terms of Service together with any other policies or terms expressly incorporated by reference.

Please read these Terms carefully before using our website or placing an order.

Nothing in these Terms is intended to exclude or restrict any statutory rights that cannot lawfully be excluded or restricted.

Our online store is hosted by Shopify Inc., which provides the e-commerce platform through which we offer our products and services.

Section 2 – Using Our Website

You may use this website only for lawful purposes.

You must not:

  • Use the website in violation of applicable law
  • Attempt to interfere with its security or functionality
  • Introduce viruses, malware or other harmful code
  • Attempt to gain unauthorised access to our systems
  • Scrape, reproduce or commercially exploit website content without permission
  • Use our website or services to infringe the intellectual property or other rights of any person

We may suspend or restrict access to the website where reasonably necessary for security, maintenance, suspected misuse or legal compliance.

Section 3 – Product Information

We take reasonable care to ensure product descriptions, specifications, photographs, dimensions and other information displayed on our website are accurate.

However, many products are supplied by specialist manufacturers and suppliers, and manufacturers may occasionally alter specifications, finishes, components or packaging.

Product images are intended to provide a reasonable representation of the goods. Colours and finishes may vary slightly due to photography, lighting, screen settings, natural materials or manufacturing variations.

Where dimensions are particularly important — for example for large fitness equipment, massage chairs or saunas — customers should check the published specifications carefully and contact us before ordering if clarification is required.

We reserve the right to correct genuine errors or inaccuracies on the website.

Nothing in this section affects your statutory rights where goods are not as described.

Section 4 – Prices

Product prices are displayed on our website and may change from time to time.

A change in price will not normally affect an order that we have already accepted, except where there has been an obvious pricing error or where otherwise permitted by law.

Delivery, installation or specialist access charges may apply to certain products or locations. Where applicable, these will either be displayed during the ordering process or communicated before the relevant service is confirmed.

We reserve the right to correct obvious pricing, promotional or product-information errors.

Section 5 – Orders and Acceptance

When you place an order through our website, you are making an offer to purchase the products shown in your order.

You will receive an electronic acknowledgement confirming that we have received your order.

For certain products, particularly supplier-direct, specialist, made-to-order or bespoke equipment, we may need to confirm availability, specifications or fulfilment arrangements with the relevant manufacturer or supplier.

If we are unable to fulfil an order, we will contact you and arrange any applicable refund.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable
  • An obvious pricing or listing error has occurred
  • Payment cannot be authorised
  • We reasonably suspect fraud or unlawful activity
  • Delivery cannot reasonably be completed to the supplied location
  • Required product or bespoke specifications cannot be agreed
  • The order would breach applicable law

Where an order has been paid for but cannot be accepted or fulfilled, any amount due to be returned will be refunded using the appropriate payment method.

Section 6 – Customer Information

You agree to provide accurate, complete and current information when placing an order.

This includes your:

  • Name
  • Billing address
  • Delivery address
  • Email address
  • Telephone number
  • Any relevant access information

It is particularly important that contact and delivery information is accurate for pallet, freight, specialist or installation deliveries, as the supplier or carrier may need to contact you before delivery.

Please notify us promptly if any information relating to an outstanding order changes.

Section 7 – Supplier-Direct Fulfilment

Many products sold by Pulse & Rest are dispatched directly from approved manufacturers or specialist suppliers.

This is particularly common for large fitness equipment, saunas, massage chairs, recovery equipment and other specialist products.

As a result:

  • Products may be dispatched from different warehouses
  • Orders containing multiple brands may arrive separately
  • Delivery methods may vary between suppliers
  • Some products may be dispatched from manufacturers located outside the UK
  • Lead times vary between products and suppliers

Pulse & Rest remains your retailer and primary point of contact regarding your purchase.

Further information is available in our Shipping & Delivery Policy.

Section 8 – Delivery

Delivery times shown on product pages are estimates unless expressly stated to be guaranteed.

Delivery times may vary depending on:

  • Supplier stock availability
  • Manufacturing schedules
  • Product configuration
  • Supplier location
  • International transportation
  • Courier or freight availability
  • Customer location
  • Installation requirements
  • Access requirements

Some of our suppliers and manufacturers are located in the UK and elsewhere in Europe, including Poland and Estonia.

Large or heavy products may be delivered by pallet, freight or specialist delivery services.

Customers are responsible for providing accurate delivery and access information and for checking that products can reasonably reach their intended installation location.

Please refer to our Shipping & Delivery Policy for further information.

Section 9 – Installation

Installation is available for selected products and locations only.

Unless expressly stated otherwise, installation is not automatically included with the purchase price.

Where installation is available, it may be performed by:

  • The manufacturer
  • The supplier
  • An approved installation partner
  • Another suitably qualified specialist

Some products may additionally require electrical, plumbing, structural or site-preparation work that is not included with standard delivery or installation.

Customers should ensure that all required site preparation has been completed before an agreed installation takes place.

Section 10 – Made-to-Order and Bespoke Products

Certain products are manufactured, configured or personalised specifically for individual customers.

This may include bespoke saunas, customised wellness equipment and other products manufactured to customer-selected dimensions, specifications, finishes or configurations.

Customers are responsible for carefully reviewing and approving any specifications, measurements, drawings, finishes or configurations submitted for manufacture.

Where a product is genuinely made to a customer's specifications or clearly personalised, different statutory cancellation rules may apply.

Details relating to cancellations and returns for these products are contained within our Refund Policy:

https://pulseandrest.co.uk/policies/refund-policy

Nothing in this section affects your statutory rights where goods are faulty, damaged, misdescribed or otherwise fail to conform to the contract.

Section 11 – Returns, Cancellations and Refunds

Returns, cancellations and refunds are governed by our Refund Policy:

https://pulseandrest.co.uk/policies/refund-policy

Our Refund Policy explains the different procedures applicable to:

  • Standard stocked goods
  • Supplier-ordered goods
  • Made-to-order goods
  • Bespoke products
  • Damaged goods
  • Faulty goods

Nothing within these Terms or our Refund Policy affects any statutory consumer rights that cannot legally be excluded.

Section 12 – Damaged or Faulty Goods

Customers should inspect deliveries as soon as reasonably possible after receipt.

If goods arrive damaged, incorrect or appear faulty, please contact:

contact@pulseandrest.co.uk

We may request reasonable supporting information such as photographs, videos, packaging photographs, shipping labels, error codes or product serial numbers to help investigate the issue.

Please retain damaged goods and their packaging while an investigation is underway where reasonably possible.

Manufacturer warranties are provided in addition to, and do not replace, applicable statutory rights.

Section 13 – Product Warranties

Many products available through Pulse & Rest include a manufacturer-backed warranty.

Warranty duration and conditions vary by manufacturer, product and intended use.

In particular, warranty terms may differ between:

  • Residential use
  • Light-commercial use
  • Full commercial use

Customers intending to use equipment within a gym, hotel, spa, studio or other commercial facility should ensure that the applicable warranty permits the intended usage.

Manufacturer warranties do not replace statutory consumer rights.

Section 14 – Business and Commercial Customers

Some statutory protections apply specifically to individuals acting as consumers rather than customers purchasing wholly or mainly for business purposes.

Commercial purchases, including larger orders for gyms, hotels, spas, studios and other organisations, may be subject to separate quotation terms or project-specific conditions.

Where separate written commercial terms have been agreed for a particular project, those terms will apply to that project alongside these Terms to the extent specified.

Section 15 – Optional Third-Party Services

Our website may provide access to third-party services, payment options, applications or tools.

These services may be governed by the third party's own terms and privacy policies.

We are not responsible for the operation of third-party services outside our reasonable control.

You should review the applicable terms before using any optional third-party service.

Section 16 – Third-Party Links

Our website may contain links to websites operated by third parties, including manufacturers, suppliers, payment providers or other external services.

We are not responsible for the content, availability or privacy practices of websites that we do not operate.

The inclusion of a third-party link does not necessarily constitute an endorsement of all information, products or services available through that website.

Section 17 – Reviews, Comments and User Content

Where customers submit reviews, photographs, feedback or other content to us or through our website, they must ensure that the content:

  • Is accurate to the best of their knowledge
  • Is lawful
  • Does not infringe another person's intellectual property or privacy rights
  • Does not contain malicious software
  • Is not defamatory, threatening, abusive or obscene

We may moderate or remove user-generated content where reasonably necessary.

Where you voluntarily submit a review or similar content for publication, you grant us a non-exclusive right to display and reproduce that content for purposes connected with operating and promoting Pulse & Rest, subject to applicable law.

Section 18 – Intellectual Property

Unless otherwise stated, the content of this website — including text, branding, layout, graphics and original materials — belongs to SJR ECOMMERCE LTD trading as Pulse & Rest or is used under licence or with appropriate permission.

Manufacturer names, product names, logos and trademarks remain the property of their respective owners.

You may not reproduce, distribute, commercially exploit or modify our website content without prior written permission except where permitted by law.

Section 19 – Personal Information

Our collection and use of personal information is governed by our Privacy Policy:

https://pulseandrest.co.uk/policies/privacy-policy

The Privacy Policy explains how personal information may be collected, used, stored and disclosed when you visit our website, place an order or otherwise interact with Pulse & Rest.

Section 20 – Website Errors and Availability

Occasionally information on the website may contain typographical errors, inaccuracies or omissions relating to matters such as:

  • Product descriptions
  • Specifications
  • Pricing
  • Promotions
  • Availability
  • Shipping charges
  • Delivery estimates

We may correct genuine errors and update website information when necessary.

We do not guarantee that the website will always be available without interruption or technical issues.

We may temporarily suspend access for maintenance, security, upgrades or circumstances outside our reasonable control.

Section 21 – Prohibited Uses

You must not use this website:

  • For unlawful or fraudulent purposes
  • To violate applicable laws or regulations
  • To infringe intellectual property rights
  • To transmit viruses, malware or malicious code
  • To obtain unauthorised access to systems or data
  • To harvest personal information unlawfully
  • To spam, phish, scrape or interfere with website functionality
  • To impersonate another person
  • To submit knowingly false or misleading information

We may restrict access to the website where we reasonably believe these Terms have been breached.

Section 22 – Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing is intended to exclude or restrict liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of rights that cannot legally be excluded
  • Any other liability that cannot lawfully be limited or excluded

If you are purchasing as a consumer, nothing in these Terms affects your statutory consumer rights.

We are not responsible for losses that were not reasonably foreseeable when the contract was entered into or that result from circumstances outside our reasonable control, except where applicable law provides otherwise.

Where a customer purchases wholly or mainly for business purposes, additional limitations may apply under any commercial terms agreed with that customer.

Section 23 – Events Outside Our Reasonable Control

We will not be responsible for delay or failure to perform obligations where caused by events outside our reasonable control.

These may include significant transport disruption, severe weather, industrial action, supplier interruption, import or customs delays, natural disasters, network failures or other exceptional events.

Where such an event affects an outstanding order, we will take reasonable steps to communicate with you and minimise disruption.

This section does not remove any statutory rights or remedies available to consumers.

Section 24 – Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

Section 25 – Waiver

If we do not immediately enforce a particular provision of these Terms, this does not mean that we have waived our right to enforce it later.

Section 26 – Entire Agreement

These Terms, together with the policies and any other terms expressly incorporated into them, form the agreement governing your use of our website and purchases from Pulse & Rest.

For bespoke or commercial projects, additional written terms, specifications or quotations may also form part of the agreement.

Section 27 – Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

If you are a consumer resident elsewhere within the United Kingdom, you may also benefit from mandatory legal protections applicable in the part of the UK in which you live.

Nothing in this section is intended to deprive a consumer of any mandatory protections or rights regarding where legal proceedings may be brought.

Section 28 – Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, services or applicable legal requirements.

The latest version will be published on this page.

Changes will not retrospectively remove rights already accrued under an existing contract where doing so would be unlawful.
